Terms and Conditions

Welcome to Anchorage Web Design. These terms govern our projects and services. By using our services, you agree to these terms.

1. Our Services
We provide website design and development, UI/UX design, post-launch support, digital marketing and AI-related services.

2. Website Projects 

2.1 Execution & Timeframes

• Estimates: Project timelines are best estimates and are not binding. Delays in feedback or content delivery will shift your "delegated work window."
• Approval & Revisions: Once a project stage is approved, any further modifications or "re-doing" work will incur additional charges.
• Project Delays: If a project is delayed by more than 4 weeks due to your action or inaction, a $1,000 Restart Fee applies to cover resource reallocation.

Change Requests: Any changes outside the agreed scope incur a minimum $500 Change Request Fee plus hourly rates.

2.2 Platform & Hosting

• Platform: Sites are custom-built. You can host with us or host the site yourself. Where a third-party provider is involved, you acknowledge that platform-wide changes or pricing from that provider are outside our control.
• Hosting Term: Hosting with us is optional and has no minimum term. You can cancel or move your site to your own hosting at any time.

2.3 Security & Backups

• Backups: Backups are handled by the hosting platform. We are not liable for data loss or restoration issues.
• Security: Infrastructure security is the responsibility of our hosting and CDN providers. We are not liable for third-party security breaches or platform vulnerabilities.

3. Retainers, Website Post-Launch Support & Pre-Paid Hours

• Website Retainers / Support Plans: Unused hours can roll over for a maximum period as specified in your proposal or agreement with Anchorage Web Design. If no specific agreement is in place, a default rollover period of 4 months applies.
• Digital Marketing Retainers: Unused hours can roll over for a maximum period as specified in your proposal or agreement with Anchorage Web Design. If no specific agreement is in place, a default rollover period of 4 months applies.
• Pre-paid Hours: A minimum 5-hour block is required for ad-hoc support. These hours are non-refundable.

4. Payments, Fees & Refunds

• Anchorage Web Design’s Standard Hourly Rate = $250 per hour.
• Milestones: We will not commence or release work until relevant milestone invoices are paid.
• Failed Payments: A $35 Fee applies to the second failed attempt to debit funds. We may pause hosting on an overdue account, but your domain and site files remain yours and we will release them on request.
• Third-party Tools/Subscriptions: If you would like Anchorage Web Design to procure any third-party tools or subscriptions on your behalf, a 20% management fee will apply.
• Refunds: We do not issue refunds once work has begun on a project. That covers deposits, progress payments and completed milestones.
• We will never hold your domain or website hostage, for any reason. If you decide to leave, we transfer your domain and hand over your site files on request. An unpaid balance is a debt settled between us, never something we resolve by withholding your property.

5. Cancellations

If you cancel a project after accepting the services, the following applies:

• Project Early Stage: If canceled before the mid-way point/design completion, you are liable for 50% of the total project fee.
• Project Late Stage: If canceled after the mid-way point, the full remaining balance is due immediately.
• Monthly Services: Cancellation during a minimum term requires payment of 50% of the remaining contract value.

6. Intellectual Property (IP)

• Your Content: You retain all rights to the content you provide.
• Your Domain: Your domain is registered in your name and always belongs to you, regardless of the state of your account with us.
• Our Tools: We retain ownership of pre-existing code, frameworks, and proprietary IP.
• Final Product (Website Projects): Upon full payment, you own the custom design elements created for your website. We reserve the right to include a small "Project Credit" link in the footer.

7. Liability

• Liability Cap: To the extent permitted by law, our total liability is limited to the total fees paid by you under the Agreement.

8. General

• Confidentiality: Both parties agree to protect each other’s proprietary information.
• Dispute Resolution: We agree to attempt negotiation and good-faith mediation before pursuing legal action.

Governing Law: This agreement is governed by the laws of the State of Alaska.
